Terms and Conditions - Gourmarket Online Store

1. Subject

1.1 These General Conditions in force are intended, together with the order form and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Service in the Gourmarket Online Shop.

1.2 The purchase of any product in the Gourmarket Online Shop implies acceptance of these General Conditions of Sale Online.

1.3 Access to the Gourmarket Online Shop is free and requires prior registration by the user.

2. Information on Products, Prices and Contents

2.1 Gourmarket reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.

2.2 The images illustrating each product at Gourmarket may differ from the product subsequently delivered.

2.3 Items on sale in the online shop are subject to existing stock and orders will be processed on a first-come, first-served basis. In the event of a temporary or permanent out-of-stock situation, the customer will be duly notified and an alternative of products with similar characteristics will be suggested.

2.4 Under Portuguese law, the prices of products are indicated in € (euros) and include VAT at the legal rate in force, as well as the cost of packaging. The cost of transport to the customer is not included.

3. Ordering and Payment

3.1 To make a purchase in the Gourmarket Online Store, the user must register as a customer.
Once registered, the user can place an order by selecting the desired products. The user must follow all the steps described in this document in order for the order to be successfully completed.

3.2 Once the order has been confirmed in the Gourmarket online store, an e-mail will be sent to the contact address registered by the customer at the time of the formalization, with all the details about the order placed. If the customer does not receive the order confirmation e-mail, he is requested to contact Gourmarket through the e-mail geral@gourmarket.pt.

3.3 Changes to the conditions of undelivered orders or cancellation of an undelivered order may be made when requested via email to geral@gourmarket.pt.

3.4 Orders placed by users from countries outside the European Union must be previously validated.

3.5 Orders will only be shipped after confirmation of stock and payment and will be processed on a first-come, first-served basis.

3.6 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by Gourmarket.

3.7 Upon receipt of the order details, the user has 3 working days to make the payment. If the User does not make payment within this period, the order will be cancelled automatically.

3.8 The Gourmarket Online Store offers the user various payment methods, including payment by bank transfer.

3.9 The proof of bank transfer must be sent to the e-mail geral@gourmarket.pt.

3.10 Payments are received in euros, regardless of the currency in which the transaction is made. The conversion rates for payments made in other currencies must be borne by the customer.

4. Shipping Costs

4.1 The shipping costs are calculated according to the weight of the products, the destination and the total value of the order.

4.2 The shipping costs are indicated on the shopping cart before the final validation of the order, in the case of deliveries to mainland Portugal.
For deliveries outside mainland Portugal, the total price of postage is calculated after confirmation of the customer's order, via e-mail.

5. Delivery

5.1 Orders will only be sent after confirmation of stock and payment and as soon as possible.

5.2 Orders will be delivered to the address indicated by the customer and in accordance with the delivery times of the shipping company. Home delivery cannot be made at PO Boxes. Orders may be delivered outside mainland Portugal, provided that the address is covered by the delivery area of the carrier.

5.3 As the transport service is contracted to an external company, possible delays in deliveries cannot be resolved by Gourmarket, and in such cases it is not possible to guarantee exact delivery times.

5.4 If for any reason the customer is unable to receive the order or pick it up at the place indicated by the carrier, the customer is requested to contact the Gourmarket Online Store immediately through the email geral@gourmarket.pt.

5.5 All products sent by Gourmarket must be checked upon delivery. If the customer finds that the order is damaged, he must immediately return it to the shipping company, indicate the reason for the return in the delivery note and immediately inform the Gourmarket Online Store through the email geral@gourmarket.pt.

5.6 If, after delivery, the customer finds that any of the items are not in conformity, he is requested to contact Gourmarket immediately via e-mail at geral@gourmarket.pt, indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all the items, so that the situation can be resolved as soon as possible.

6. Returns / Complaints

6.1 The Gourmarket Online Store allows the return of the products within 14 days in accordance with the terms of Decree-Law no. 143/2001 and Decree-Law no. 82/2008 of 20/5. However, when the product is returned, it must remain in perfect condition (including the original packaging, labels and back labels).

6.2 To request an exchange or return, the customer is requested to contact Gourmarket via e-mail at geral@gourmarket.pt indicating the invoice number and the reason for the invoice.

6.3 Gourmarket is responsible for returning defective products and incorrect shipments, as well as for shipping and collection costs when the customer reports this within 14 (fourteen) days from the date of receipt of the product. Once the goods have been received at our premises and the status of the goods has been validated accordingly, their value will be returned by bank transfer.

6.4 Gourmarket shall not be liable for any deficiencies resulting from incorrect use, negligence or poor storage conditions on the part of the Customer.

6.5 In the event of a consumer dispute, the consumer may have recourse to the following alternative dispute resolution to entity: CICAP ( http://www.cicap.pt).

These general terms and conditions of online sales may be changed without prior notice and must therefore be consulted prior to placing any order.
